McDonald Vague works closely with the legal profession, providing lawyers with up-to-date information and advice on insolvency and business recovery issues.  Many of the more complex issues we face on assignments are legal rather than accounting.

We have a good reputation for returning money to creditors and are happy to undertake recovery work on behalf of your client.  We are also happy to be contacted by creditors directly and will listen to their concerns.

We can offer you preliminary advice on your clients' situation, outlining the options available to them.  We will treat your clients with empathy and respect and enable you to stay involved with the assignment should you wish to.

 

Winding-up applications

Please contact us if you are considering issuing a winding-up application on behalf of a client.  We regularly act as court-appointed liquidators and are able to provide consents to act for the court.  We are also able to recommend debt collection agencies to use.

 

Reciprocal work

Our work inevitably involves obtaining independent legal advice and, where appropriate, issuing legal proceedings.    We are often able to offer reciprocal work where the appropriate insolvency skill sets are held.  We also require assistance with debt collection, property sales, leases and other legal matters from time to time.

 

The earlier you speak to us the better

If you have a client facing financial difficulties, we always recommend that they speak to us earlier rather than later.  This gives us a better opportunity to preserve value and achieve a successful outcome for all stakeholders.  If your client has received a statutory demand, they should contact us immediately. If the shareholders wish to appoint their own liquidator, they have the period before the date the application is served.  Following this, the liquidator will be one nominated by the unpaid creditor.  There is also likely to be a period of delay before a court hearing is set down, during which any deposition of the company's assets may be at risk of later challenges.
